To obtain protection in Spain, the trademark must be registered by filing a trademark application at the Spanish Patent and Trademark Office (SPTO).The application process includes a formal examination (the time involved in this stage is around 20 days) as well as a substantive examination on absolute grounds for refusal. Before registration the trademark application is published in the “Boletin Oficial de la Propiedad Industrial”, issued daily. The opposition period is 2 months from publication date of the application. It takes approximately 4-5 months from first filing to registration.
A registered Spanish trademark is valid for ten years from the date of filing of the application. It can be renewed indefinitely for further periods of ten years.
